ABC reports that the family of a 6-year-old girl is filing a wrongful death suit against both the driver of the car that hit her and the on-demand car service Uber, for which he works.

The girl was crossing a street in San Francisco on New Year’s Eve with her mother and 5-year-old brother when the three were struck by a car driven by a man who works for Uber, which is similar to a taxi but is not licensed or regulated by the city. The driver was in his own car, which was not provided by the company, and he had no passenger when the collision occurred; however, he was using the Uber app at the time. For their part, Uber maintains that “the driver was not providing services on the Uber system during the time of the accident” and is denying insurance protection to both the driver and the girl’s family.

In light of the accident, San Francisco Supervisor Jane Kim is calling for increased scrutiny of Uber and other “transportation network companies.”
