An initiative that seeks to raise the state cap on medical malpractice awards from $250,000 to $1.1 million, in addition to requiring drug testing for doctors and the establishment of a database to help prevent fraudulent prescriptions, has gathered the necessary support and will be on the ballot in November.

The Troy and Alana Pack Patient Safety Act is the brainchild of a father whose two children were killed by a drunk driver who was also high on prescription drugs that had been legally obtained from physicians. The initiative obtained over 840,000 voter signatures, despite the opposition of the medical community.

According to California Medical Association spokesman Sam Springer, the organization opposes the initiative because it will raise malpractice insurance premiums, causing the cost of healthcare to rise. So far, opponents have raised more than $30 million to defeat the initiative.
