The latest decision handed down from the United States Supreme Court continues to shield generic drug makers from lawsuits that consumers might bring against their potentially dangerous products.

According to the Wall Street Journal, the Supreme Court voted 5-4 to overturn a $21 million judgment awarded to a New Hampshire woman who sued the pharmaceutical company behind an anti-inflammatory drug that left her with severe injuries. Justice Samuel Alito, writing on the court’s decision, pointed to federal drug regulations that prohibit product liability suits against generic drug companies due to the fact that generic medications are required to be identical to their brand-name counterparts.

Product liability claims can still be brought against branded pharmaceutical companies; however, holding generic drug makers responsible for their product continues to be an uphill legal battle.
