More than 10,000 lawsuits are pending against Johnson & Johnson, manufacturer of the ASR XL hip implant, who withdrew the device from the market in August 2010 due to its high rate of failure. According to one attorney, metal debris created by the motion of the ball rubbing against the cup in the false hip led to the release of potentially toxic metal ions into plaintiffs’ bloodstreams.

Despite warnings from key officials and medical experts, Johnson & Johnson waited several years to recall the product. Additionally, they failed to test the device properly, settling for limited machine testing rather than controlled clinical studies on people.

The company offered to pay more than $200,000 apiece to each affected hip recipient in order to avoid trial. However, plaintiffs’ lawyers have so far rejected the offer.
