The Supreme Court has denied Wyeth’s request for a new legal trial in its hormone replacement therapy case. The drug maker’s hormone replacement drugs, Prempro and Premarin, have been linked to increased risk of heart attack, stroke and breast cancer.
In the original trial, a woman who developed breast cancer after being given these drugs was awarded $27 million in punitive damages, and $2.7 million in compensatory damages. She claimed that she was not adequately warned of the increased cancer risk. Later a federal judge struck down the punitive damages. A court of appeals then ordered a partial retrial to re-evaluate the level of punitive damages. Wyeth argued that this would violate its constitutional rights and asked for a new trial.
The Supreme Court’s decision to deny Wyeth’s request for a new trial is a positive sign. Despite their “deep pockets” and large legal teams, pharmaceutical companies cannot always prevail.
