A 75-year-old woman sought a consultation for a tummy tuck, during which she mentioned to her surgeon that she suffered from mild urinary incontinence. Her surgeon referred her to his partner, who recommended corrective surgery for the problem. The surgery was not reasonably calculated to address her urinary incontinence, and instead left her with severe, permanent fecal incontinence and little to no vaginal opening. Despite a follow-up operation, the plaintiff is still unable to engage in sexual intercourse with her husband. Jeffrey A. Milman and Jessica Vanden Brink with Hodes Milman represented the plaintiff and her husband; an arbitration of $90,000 was awarded.
