A 32-year-old male, who had been involved in a car accident, underwent surgery to replace a damaged disc in his neck. Due to surgeon’s negligence, he was given the wrong type of artificial disc at the wrong location. The mistake was due to a scheduling error resulting in the patient having to undergo another surgery to replace both artificial discs. The patient was unable to return to work, forcing him to obtain alternative employment at a lower wage. Dan Hodes with Hodes Milman represented the patient and obtained an $800,000 settlement.
