A woman who underwent bariatric surgery and suffered post-operative complications learned that she required emergency surgery to remove an endo-bag filled with resected intestines that had been left behind in her abdominal cavity by the surgeon. The plaintiff, who experienced stomach pain, nausea and vomiting following a surgery to eliminate weight gain due to a thyroid condition, underwent two surgical revisions of the original procedure. Following the second reparatory procedure, the plaintiff displayed symptoms of infection and was taken into surgery yet again, where it was discovered that a specimen bag containing intestines that had been removed during the previous procedure had been left inside of the patient’s body. Kevin G. Liebeck of Hodes Milman represented the plaintiff in a medical malpractice claim, which was settled in mediation for $92,500.
