A 78-year-old woman was forced to undergo a second surgery on her leg after a device implanted to fix a previous fracture failed prematurely. The woman, who originally fractured her femur after falling in her daughter’s home, underwent surgery shortly after the injury occurred, with her surgeon utilizing a locking intermedullary nail to stabilize the fracture. Two months later, the plaintiff felt a “pop” in her hip, followed by immediate pain; X-rays indicated failed hardware, and the defective device was subsequently removed and replaced in a second surgery. Kevin Liebeck of Hodes Milman represented the plaintiff in the product liability case against the manufacturer of the device. The case was settled at mediation for $75,000.
