Hodes Milman represented a husband and wife who gave birth to a Down Syndrome baby girl after doctors neglected to exercise proper care while interpreting prenatal genetic test results. During the second trimester, doctors tested the fetus for Down Syndrome and other genetic abnormalities on two separate occasions, yet despite observing warning signs, they did not interpret the results of these tests as indicative of Down Syndrome. Hodes Milman attorneys argued that the doctors failed to obtain a proper analysis within the required standard of care and, had this been done, it is probable that the result would have been positive for Down Syndrome. Hodes Milman settled the case for $1.75 million on behalf of the plaintiffs.
